How we got the electoral college ?

As the U.S. Constitution was being drafted in the hot Philadelphia summer of 1787, the Constitutional Convention had many proposals before it on how to elect a President. Under the existing Articles of Confederation and Perpetual Union, the President was a member of the Continental Congress, chosen by his colleagues.  The President served a one-year term.

There was one proposal to have the President selected by the U.S. Congress and another proposal would have the President chosen by the state legislatures.  Both proposals were rejected.  There were fears that if the Congress were to choose the President, corruption would ensue, and that if the State Legislatures chose the President, he might become a martinet.  A direct popular vote of the President was also proposed and subsequently rejected.  At the time, most citizens of the young nation had little knowledge of the other states.  The fear here was that Americans would vote only for candidates from their region or states and that the candidates from the largest state, would perpetually hold the Presidency because they would garner the most votes.

Keeping with the Roman Republic as the archetype of the new government, the Convention agreed to an indirect election of the President.  Voters would not directly select the President, but instead would select electors who would in turn select the President. Under this system, each state would be awarded electors based upon the number of representatives it sends to the U.S. Congress.  With every state having two U.S. Senators and at least one U.S. Representative, the minimum number of electors in any state would be three.

Despite the prevailing contemporary consensus, there is no explicit language in the U.S. Constitution mandating how the states may choose their electors. The Founders respected federalism, delegating that responsibility to the states. Article ll, Section 1, Clause 11 of the U.S. Constitution states: "Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors." In 1789, the year of the first Presidential election, voters of only five states were permitted to mark ballots for Presidential electors. The other states granted the power of voting for Presidential electors to the state legislatures.  In fact, New York did not even appoint electors because their legislature was stalemated.

This awkward arrangement of awarding electors gradually changed, eventually being supplanted by the "winner-take-all" method. The two exceptions are Maine and Nebraska, which award their electors based upon the winner of each congressional district, with the two at-large electors going to the winner of the state.  In short, there is no explicit stipulation in the U.S. Constitution mandating that the states allow their residents to vote for Presidential electors.  Theoretically, the states could agree to put this power back in the hands of the Legislators.

In 1789, most states only allowed property owners the right to vote. This gradually changed, not by a constitutional amendment, but through a state-by-state process.  The winner-take-all approach of awarding electors was a scheme devised by partisan parochial interests to maximize their political advantage.  It was not the dream of the Founding Fathers.  In fact, there is no mention at all of the winner-take-all system in the Federalist Papers and no mention of it at the Constitutional Convention.

In the first four Presidential elections, members of the Electoral College were permitted to select two candidates.  The candidate with the most votes became President while the candidate with the second most votes became Vice President.  This system was amended after the volatile 1800 Presidential Election in which Thomas Jefferson and Aaron Burr each mustered the same amount of votes. To prevent a repeat of this quagmire, the twelfth amendment to the U.S. Constitution (ratified in 1804) mandates that  "the Elector shall cast a separate vote for . . . President and Vice-President."

The term "Electoral College," like the winner-take-all method not mentioned in the U.S. Constitution nor was it mentioned at the Constitutional Convention. The provision of the Constitution establishing our electoral system is Article ll, Section 1, Clause 11, which states: "Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector."  The phrase "Electoral College" was not enshrined into a federal statute until 1845.

If no candidate garners the requisite 270 votes needed to win a Presidential Election, the election is thrown into the U.S. House of Representatives.  The House must then choose a President from the three top finishers. The U.S. Senate subsequently chooses the Vice-President from the top two Vice-Presidential finishers. There are a total of 538 possible electoral votes: 535 voting members of the U.S. Congress and the three electors awarded to the District of Columbia by the Twenty-third Amendment to the U.S. Constitution ratified in 1961.

In four of the fifty-six Presidential elections since 1789, the Presidential candidate who garnered the most votes lost the election because his opponent won more votes in the Electoral College.  In 1824, Andrew Jackson defeated John Quincy Adams in the popular vote, but lost the electoral vote. Likewise in 1876 Samuel Tilden won the popular vote but Rutherford B. Hayes won in the Electoral College. In 1888, Grover Cleveland won the popular vote but lost in the Electoral College to Benjamin Harrison, and in 2000, Al Gore won the popular vote but lost to George W. Bush in the Electoral College.

In addition there have been times when this scenario was barely missed. In the 1880 Presidential election, Republican James Garfield defeated Democrat Winfield S. Hancock by just 7,368 popular votes.  However, in the Electoral College the margin was much wider, with Garfield garnering 214 votes and Hancock mustering just 155 votes. In 1968, Republican Richard M. Nixon defeated Democrat Hubert Humphrey by less than one percentage point in the popular vote, yet in the Electoral College Nixon won by over 100 electoral votes.  In 2004, Republican George W. Bush won nationally by over 3 million votes, yet if just 60,000 votes had switched in Ohio, Democrat John Kerry would have assumed the Presidency.

To avoid this scenario, while maintaining Federalism, California Computer Scientist John Koza devised a plan wherein states would enter into an Interstate Compact, agreeing to award their electoral votes based upon the winner of the Presidential election as opposed to the current winner-take-all method in which the states award their electors on the basis of the candidate who wins that state. The agreement will be actuated once enough states constituting 270 electoral votes agree.  Currently eight states and the District of Columbia have signed on to the pact, constituting a total of 149 electoral votes.

This compact will guarantee that the candidate who musters the most popular votes would actually win the election while respecting the states' sovereign right to chose their electors in whichever way they see fit.

You have to understand that as a lady, she loves to be loved, adores to be adored and needs to be needed. Never fail to phone her, even when she least expects it. I once called some girl that I was interested in at four o'clock in the morning. When inquiring of what I was doing up so early, I told her I was in thirteenth heaven, where people think of their loved ones when they can't sleep. Wow! First thing early the next morning, she was at my door with a king-sized hug for me. No matter how many dates you take her, don't make any elbow - exceeding moves after any date, just drop her home and with a friendly handshake, wish her good night. Don't kiss her when she expects you to. Your respect as a gentleman will be earned on how patient you are with her when it comes to such matters as kissing her and accessing her inner graces.

The writing is on the wall that you want her, but you can't have her just yet. Increase your demand. Try to show her that men are also hard to get at times. Make her realize that when she feels a little dizzy, a little tired, a little sad, a little sick, a lot bored and very much cold, she's actually missing vitamin you. By this time, she'll be so much into you and since love is truthful and is characterized by open and honest communication, honestly promise her your everlasting devotion, loyalty, respect, and your unconditional love for a lifetime. Prove to her that you'll always be there for her, to listen and to hold her hand, and that you'll always do your best to make her happy, and feel loved.

Remember, patience is the key to her heart; be like that gardener watching a fruit as it hangs on the tree, day after day admiring it, but, exercising tremendous self-discipline, neither feeling the fruit, nor pinching it, nor testing it to see if it is ready.
